What Information We Collect and How It's Used

Categories of Information Collected

To provide you with our services, we may ask you to provide personal information necessary for the provision of those services. If you do not provide personal information, we may not be able to provide you with our products or services.

We collect the following categories of information (whether or not it is personal information):

- Your profile information: We may collect and use your avatar, personal signature, nickname, gender, timezone, language, sports preferences, and regional data.

- Personal physical data: After launching CyberWear, we need you to provide birth month, height, weight, and gender data.

- Device-recorded data: When you synchronize data from related devices with CyberWear, we record personal data, including activity information, sleep information, heart rate information, blood oxygen saturation (SpO2), weight, impedance, distance, stroke type, pace, exercise time.

- Behavioral annotation information: When you choose to mark related behaviors, CyberWear will collect data, including but not limited to activity information, heart rate data, for providing you with corresponding service marking features.

-Call information: When you use call and SMS reminder functions, CyberWear will obtain call, SMS, and contact-related data. With your permission, the related call, SMS, and contact data are used for display on wristbands, watches, and other devices, but CyberWear does not store your call, SMS, and contact-related data.

-Mobile information: When you use CyberWear, we need to obtain your mobile operating system version and mobile phone brand model, mobile hardware identifier (such as IDFA, IMEI), mobile system time, mobile alarm clock.

- Network usage data: We may collect network type and network signal data related to specific features of CyberWear.

- Music control information: When you use the music control function, we will collect music information on your phone (such as song name, song playback status, volume) and synchronize it to the device. This information is only displayed on the device, and we do not store the aforementioned information.

-Location data: When you use location-based program services or features, we may collect your location data.

-Feedback information: When you submit feedback, we will collect user feedback logs, contact information, and other information based on your choices.

- Device information: When you use CyberWear to connect a hardware device, including but not limited to the device's unique identifier, firmware version, approximate geographic location data (non-personal data), and related functional usage statistics (non-personal data) will be transmitted to the server. The aforementioned data collection may also apply when you update your system or software, restore factory settings, etc.

- Information you actively submit when using related functions: If you set goals, heart rate reminders in CyberWear, the exercise goals and weight goals you fill in, heart rate reminder values will be collected to alert or warn you when the goals are achieved. If you choose to use the women's health function, the menstrual duration, the interval days between the start of the last two menstrual periods, the date of the last menstrual period, and the menstrual period's physical condition and mood submitted each time when using this function will be collected. If you choose to create your own watch face, the pictures you upload will be collected by us as your watch face background.

- Self-start: CyberWear is a smartwatch supporting software. To ensure we provide you with message push services, such as displaying the messages you choose from third-party applications on the watch in a timely manner. We will attempt to self-start CyberWear to receive message push when your device status changes (network status, after booting, app updates, etc.).

- System permissions: Refers to the system permissions that the mobile intelligent terminal operating system opens to the App, which has the ability to collect personal information, also known as system permissions or permissions. When you use some business functions of CyberWear App, you authorize CyberWear App to call system permissions, including: album, storage, camera, location, health. The call for system permissions will be obtained with your consent in advance, and you can also set your system permissions to "Me-Settings-System Permissions" or "Me-Settings-Function Permissions", choose to turn on or off.

Some third-party SDKs will collect ANDROID ID, mainly for the following purposes:

a) To provide SDK services based on devices.

b) For statistical analysis and service improvement.

How will this personal information be used?

The purpose of collecting personal information is to provide you with products and/or services and to ensure that we comply with applicable laws. You hereby agree that we process personal information for the purposes specified in this Privacy Policy and disclose it to our affiliated companies (involving communications, social media, technology, and cloud businesses) and third-party service providers (defined below).

We may use your personal information for the following purposes:

- Calculate sports and health results: We will use personal physical data and/or device-recorded data to calculate sports and health results for display in the APP and/or device, such as: BMI, PAI, muscle, body fat, water, protein, basal metabolism, visceral fat, bone mass, body type, body age, stress conditions, calorie consumption, maximum oxygen volume, training effects, training load, recovery time, blood oxygen saturation.

- Physical condition analysis: Based on the personal physical data and device-recorded data you provide, we provide analysis related to your physical condition for your reference. For example: provide you with an ideal weight range for reference; show you your current and/or all-day stress value and/or stress change trend.

- Provide CyberWear services: After the device is synchronized with CyberWear, the data recorded in the device will be synchronized to CyberWear and displayed to the user.

- Display call information: When you receive calls or text messages, some devices that support this function will display call or message data.

- Display music information: When using the music control function, some devices that support this function will display music information (e.g. song name, song playback status, volume).

- Determine if the mobile phone is supported: The information related to the mobile phone will be used to determine if your mobile phone can use CyberWear.

-Provide alarm reminder functions: We will collect your mobile phone alarm information and remind you in time through the device's vibration when you turn on the mobile phone alarm reminder.

- Bluetooth photo taking: You can control the mobile phone's photo taking through some devices that support this function. To do this, the device will pair with the mobile phone via Bluetooth for photo control, and will also request mobile phone Bluetooth permissions during the pairing process.

-Provide women's health functions: When you choose to use the women's health function, you can record and view menstrual cycle-related information on some devices that support this function or in CyberWear; we will predict your menstrual cycle based on the information you fill in and remind you. We may also recommend suitable training courses for you based on the menstrual time and physical condition during the menstrual period that you fill in.

- Display sleep information: We will use personal physical data and device-recorded data to calculate and analyze your sleep situation for display in CyberWear, such as sleep score, sleep time, rapid eye movement sleep stage (REM), sleep duration distribution, sleep breathing quality.

-Provide heart health monitoring functions: Some devices support heart health monitoring functions. If you choose to turn on this function, we may collect your heart rate information to display your heart rate status, so that you can be reminded through the device when data changes, and display it on the device and CyberWear.

- Provide network-related services: CyberWear will prompt users based on different network types and network signals, such as the traffic required to download sports-related videos and determine if there is a new version of CyberWear that can be updated.

- Statistical analysis: We will analyze our services or device situations and may share these statistical data with the public or third parties for displaying product or service usage trends, optimizing products and services, and displaying rankings, friend PK, etc., but these statistical information will not contain any of your identity recognition information.

Cookies and Other Technologies

What data we collect and how we use such data? CyberNex and third-party service providers use technologies such as cookies, tags, and scripts to analyze trends, manage websites, track user movements, and gather demographic data about our user base. We receive reports from these companies on an individual and aggregated basis regarding the use of these technologies.

Record files: Like many websites, we collect certain data and store it in record files. This data includes Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, operating systems, date/time stamps, and/or clickstream data. We do not link this automatically collected data to other data we collect about you.

Mobile analytics: We use mobile analytics software in some mobile applications to understand how users use our mobile software features. This software may record the frequency and type of event activity, usage patterns, performance data, and crash information related to your use of the mobile application. We do not link the data stored in the analytics software to any personally identifiable information you submit within the mobile application.

Regional storage - HTML5/Flash: We use Local Shared Objects (LSOs), such as HTML5 or Flash, to store content and preferences. Third parties with whom we partner to provide certain features on our website or to display advertising based on your web browsing activity also use HTML5 or Flash cookies to collect and store information. Various browsers provide their own management tools for deleting HTML5 LSOs.

With whom do we share your information?

We do not sell any personal information to third parties.

We may sometimes disclose your personal information to third parties in order to provide you with the products or services you have requested.

We may disclose your personal information to third-party service providers and affiliated companies as listed in this section. In all the situations described below, you can be assured that CyberNex only shares your personal information with your authorization. You should understand that in any of the situations described below, when CyberNex shares your personal information with third-party service providers, CyberNex will contractually ensure that the practices and obligations of the third parties comply with the applicable local data protection laws. CyberNex will contractually ensure that third-party service providers comply with the privacy standards applicable to them in your jurisdiction of residence.

Sharing Information with Our Group and Third-Party Service Providers

We may integrate SDKs provided by third-party services in our devices or Apps to provide you with all the functions of our products and services. We may disclose your personal information to other CyberNex affiliated companies (involved in communications, social media, technology, or cloud business) or our third-party service providers (our mailing stores, delivery service providers, telecommunications companies, data centers, data storage facilities, customer service providers, advertising and promotion service providers, agents representing CyberNex) from time to time. Such third-party service providers may process your personal information on behalf of CyberNex or for one or more of the purposes described above. Currently, our third-party service providers include the following two major types:

1) Analytics service providers. Unless you give us permission, we will not share your personally identifiable information (information that can identify you, such as your name or email address, and through which we can contact you or identify your identity) with partners who provide advertising and analytics services. We will provide these partners with information about ad coverage, ad click-through rates, and effectiveness, without providing your personally identifiable information, or we will aggregate this information so that it does not identify you personally), to help them understand their audience or customers.

2) Vendors, service providers, and other partners. We send information to vendors, service providers, and other partners globally who support our business, such as providing technical infrastructure services, analyzing how our services are used, measuring the effectiveness of ads and services, providing customer service, providing product features, facilitating payments, or conducting academic research and surveys.

We ensure that we only share and provide your personal information for legitimate, legal, necessary, specific, and explicit purposes. Your personal information is stored on secure servers and protected in controlled facilities. We classify your data based on its importance and sensitivity and ensure that your personal information has a reasonable level of security. Similarly, we have special access control measures for cloud-based data storage. In summary, we regularly review our information collection, storage, and processing practices, including physical security measures, to prevent any unauthorized access to and use of your information.

What Can You Do?

You can prevent others (unless they are authorized by you) from disclosing your login password or account information by setting a unique password for CyberNex to prevent other website password breaches from endangering your account security. Whenever you log in, especially on someone else's computer or a public internet terminal, you should always log out at the end of the session.

We are not responsible for any security breaches caused by your failure to keep your personal information confidential. Although there are provisions above, if any other internet user unauthorizedly uses your account or any other security vulnerability occurs, you should immediately notify us. Your assistance will help us protect the confidentiality of your personal information.

Retention Policy

We retain personal information based on the period necessary for the purposes for which it was collected as stated in this Privacy Policy and specific service privacy policies, or to comply with applicable legal requirements. Personal information will be deleted or anonymized after it has served the purpose of collection, or after we confirm your deletion or cancellation request, or after we cease to operate the corresponding product or service.

Access to Other Features on Your Device

Our applications may access certain features of your device, such as Wi-Fi network status, and other features. This information is used to allow these applications to operate on your device and interact with you. At any time, you can turn off the application or contact us to revoke permission at the device level.

CyberNex recognizes that everyone's concerns about privacy vary. Therefore, we provide various ways for you to choose to limit the collection, use, disclosure, or processing of your personal information and control your privacy settings:

Empty Data, Withdraw Consent
